What Is A Work Pass?



Work pass is a generic term used for a legal authorization that allows a person to take employment. It is most usually used in the reference to the instances where a person is allowed to work in a country where one does not have the citizenship. This term is also used in the reference to the minors who in few jurisdictions need a permit so that they can legally work because of Child labor laws. In an industry, a work pass might be needed to execute the features within a factory that is outside of the normal operational tasks and in some places they may be called as permit to work even.

Who shall apply for the work pass 

The work pass is for the foreigners who:
·         Wish to work in that country and
·         Are from an authentic source of territory and country.
A prospective employers shall must apply first to the Controller of the Work Passes for a Work Pass before employing the worker. Before that, the business employers who have never ever applied for the S Passes of WP before have to declare the business activity.
There are certain regulations and rules that the WP holders and even the employers shall follow.
An employer who is willing to employ a Malaysian valid WP in that country then they have to apply for a separate Work Pass:
·         One the approval is done, the new employer will then be issued an IPA letter  that will state when the new Work pass shall be collected
·         The current employer should also cancel the worker’s existing WP before or on the scheduled collection date.

Age Criteria to apply for a Work Pass

The minimum age criteria for all the non-domestic international workers are now 18 years old. To apply for a Work Pass, the Malaysians have to be below 58 years of age and the non-Malaysians have to be below the age of the 50 years.

Requirements for the Employer

When you employ an international worker in any country, it is your duty to:
·         Pay the worker a fixed monthly salary
·         Pay the levy of Foreign worker
·         Do the arrangements for the medical examinations of the foreign worker as needed by the controller of the work Passes
·         Do the payment of the medical care and the expenses of their hospitalization.
·         Employers of the international workers are needed to buy and manage the medical insurance for their workers.
·         The employers shall satisfy their primary terms and conditions of the employment as mentioned in the Employment Act.
·         Make sure that the international worker shall not engage himself in any sort of the employment other than the one mentioned in Work passes. The employee shall not also engage himself in any sort of freelancer work or self employment
